1Purpose and acceptance

These Terms govern the use of the Dr. BookPay app and the drbookpay.app website, operated by LEARN & EDUCATION APOIO A EDUCACAO LTDA, CNPJ 43.946.548/0001-31, Av. Paulista, 1776, São Paulo/SP. By creating an account or using Dr. BookPay, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

2What Dr. BookPay is

Dr. BookPay is your practice’s scheduling system: calendar, booking page, RaVir IA on WhatsApp, reminders, messages to patients, billing, and payment collection. Dr. BookPay is the tool. The medical appointment and every medical act belong to the doctor, who is responsible for them. Dr. BookPay is not an electronic medical record and does not replace the doctor’s medical record.

RaVir IA does not give health advice. It handles scheduling and billing. It passes any clinical question on to the doctor. Even so, artificial intelligence can make mistakes: it may give an incomplete or incorrect answer. The practice sees the conversations, can take over at any time, and checks anything important.

Messages depend on third parties. Reminders and messages depend on WhatsApp, email, the internet, and the patient’s device, which are beyond our control.

5Guaranteed Appointment (charging before the appointment)

6Your patients’ data

Data you enter or receive about your patients belongs to your practice, and you decide how it is used (Privacy Policy, section 1). You confirm that you have the right to enter their data and send them messages, and that you will handle their requests about their own data. You also agree not to record clinical information (diagnosis, tests, treatment plan) in Dr. BookPay, since it belongs in the medical record. To provide the service, you grant us a free, non-exclusive license to store and process this content for one purpose only: operating Dr. BookPay for you.

7Messages and the practice’s page

8Payouts

Payments and payouts are processed by our payment processor partner and are also subject to its terms, including those about timing, refunds, and disputes. To receive payments through Dr. BookPay, the practice must complete the registration required by the processor.

9Acceptable use

You may not use Dr. BookPay for illegal purposes. You also may not attempt to bypass technical or plan limits, overload or reverse engineer the service, resell access, or use Dr. BookPay to build a competing product based on our systems.

10Intellectual property

The app, the Dr. BookPay brand, the website, and the systems belong to Learn & Education or its licensors. These Terms grant you only the right to use the service. Your practice’s content remains yours (item 6).

11Service availability and changes

We do not guarantee continuous, uninterrupted operation: the service may stop for maintenance or for reasons beyond our control. The product evolves, and we may add, change, or remove features. Any change that significantly reduces an active paid plan will be announced with reasonable advance notice.

12Force majeure

We are not liable for unavailability caused by events beyond our reasonable control. This includes internet, power, and provider failures (including WhatsApp, the payment processor, and artificial intelligence), attacks, government actions, and acts of God or force majeure.

13Suspension and termination

We may suspend or close accounts that violate these Terms, with notice when possible. You can close your account anytime in the app (Your account › Delete account) or through support. The Privacy Policy explains what happens to your data.

14Limitation of liability

To the maximum extent permitted by law, our liability is limited to the amount you paid Dr. BookPay in the 12 months before the event. We are not liable for indirect damages or lost profits. We are also not liable for decisions made based on RaVir IA’s responses, or for message delivery failures caused by third parties (item 2). Nor are we liable for medical care. Nothing here limits rights guaranteed to you by law.

15Apple and Google

Apple Inc. and Google LLC are not parties to these Terms; the relationship is solely between you and Learn & Education. The app stores provide no support or warranty for the service. You represent that you are not in an embargoed country or on a list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

17Changes, governing law, and venue
